1 Mr Chairman, the International Law Commission’s work on the articles is an important and valuable contribution to the ongoing discourse on the topic of diplomatic protection.
2 Insofar as the articles reflect State practice and are consistent with customary international law, the articles provide welcome clarity on the state of the law. As regards other elements of the articles that demonstrate progressive development of the law, the articles provide a fertile ground for States to continue dialogue on this topic and is a useful reference for those who apply international law.
3 Mr. Chairman, this topic is closely tied to the related topic of State responsibility for internationally wrongful acts. Any future action on this topic should therefore track the developments on that topic.
